Terms of service

These terms are the agreement between you and Bangarang Apps LLC for the use of SimpleInvite. They apply to hosts — people who open an account and send invitations. A guest answering an invite is not party to them.

1. The agreement

SimpleInvite is operated by Bangarang Apps LLC, a limited liability company formed in Virginia, United States. By creating an account or sending an invitation you accept these terms. If you do not accept them, do not use the service.

You must be 18 or older to open a host account, and you must give us an email address that reaches you.

2. The people you invite

This is the part that matters most, so it comes first.

When you add someone to an event you are telling us three things, and you must be able to stand behind all three:

  • You know this person.
  • You have their permission to send them an invitation from you through SimpleInvite, at the number or address you gave us.
  • The number or address is theirs, and you typed or pasted it correctly.

3. This is not a mailing tool

SimpleInvite exists to invite people you know to something you are hosting. It is not a way to reach a purchased list, a customer list, a list of people who once filled in a form, or anyone who has not agreed to hear from you.

You may not use SimpleInvite to send promotional messages, sales outreach, newsletters, fundraising appeals to strangers, political messaging, or anything else whose purpose is reaching people in bulk rather than inviting people you know.

If what you are about to send would read as an advertisement to the person receiving it, it does not belong here.

4. Acceptable use

You agree not to use SimpleInvite to:

  • Send anything unlawful, threatening, harassing, defamatory, or hateful.
  • Impersonate another person, or send invitations that appear to come from someone else.
  • Send to someone who has told you, or told us, to stop.
  • Upload a photo you do not have the right to use, or that shows a person who has not agreed to it.
  • Work around a limit, cap, or opt-out, including by spreading one event across several accounts.
  • Probe, scrape, overload, or attempt to break the service or the systems it runs on.
  • Resell the service, or use it on someone else's behalf as an agency without telling us.

5. Your account

You are responsible for what happens under your account, including anything a co-host does on an event you own. Keep control of the email address you sign in with — anyone with access to it can reach your account.

Tell us at help@simpleinvite.app if you think someone else has got into your account.

6. What the service does, and what it does not promise

We send invitations, reminders and updates on your instruction, record the answers we receive, and show you the count.

We report what we observed, not what we hoped: an invitation we sent is marked sent, and it is marked delivered only when the provider tells us it arrived. Messages can be delayed, filtered, or blocked by an email provider or a mobile carrier, and none of that is within our control.

There are limits on how much can go out — per event, per day, and per account — so that the service stays deliverable for everyone. We will tell you when you reach one. We may lower or raise a limit for a specific account where it is being used well or badly.

We may change, add to, or withdraw features. Where a change removes something you rely on, we will tell hosts before it happens.

7. Paying for an event

Pricing is on the pricing page and is part of these terms. An event with up to 30 guests is free. Above that, an event is charged once, as a flat price, at the amount shown before you send.

You are never charged before your first send on an event, and a free event is never moved onto a paid tier after it has gone out.

Payment is taken by our payment provider. Prices are in US dollars and do not include any tax that may apply where you are.

If an event is cancelled, or something on our side stopped your invitations going out, write to help@simpleinvite.app and we will refund that event.

8. What you upload stays yours

Your events, your guest list, your notes and your photos are yours. You give us permission to store them, render them into invitations and posters, and send them to the people you invited — which is what the service is — and nothing beyond that.

We do not use your photos or your guest list to promote SimpleInvite. If we ever want to show something of yours, we will ask first.

9. Ending it

You can delete your account at any time from settings. When you do, we mark it deleted, cancel any live event — the people who said yes are told the event is cancelled — and stop every scheduled message. What happens to the data after that is set out in the privacy policy.

We can suspend or close an account that breaks these terms, that generates a rate of opt-outs or complaints high enough to threaten delivery for other hosts, or that is being used for the bulk sending section 3 prohibits. Where we can, we will tell you first and give you a chance to fix it. Where a suspension is needed immediately to protect other people, we will act first and explain afterwards.

A paid event that we cancel for our own reasons is refunded. A paid event closed because of a breach of these terms is not.

10. Disclaimers

The service is provided as it is. We do not warrant that it will be uninterrupted, that every message will arrive, or that it will be free of faults, and to the extent the law allows we exclude the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You are responsible for your event. We do not host it, run it, or take part in it, and we are not responsible for what happens there or for how the people you invited behave.

11. Limitation of liability

To the extent the law allows, Bangarang Apps LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising from your use of SimpleInvite.

Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or one hundred US dollars.

Some jurisdictions do not allow these exclusions. Where that is so, they apply to you only as far as the law permits.

12. Your responsibility for what you send

If a claim is brought against us because of the messages you sent, the people you added, or the content you uploaded, you agree to defend us against that claim and to cover what it costs us, including reasonable legal fees.

This is the other side of section 2. We carry the invitations; you decide who receives them.

13. Changes to these terms

We may change these terms. The effective date at the top changes with them, and we will email hosts before a material change takes effect. Continuing to use SimpleInvite after that date means the new terms apply.

14. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Any dispute that cannot be settled between us goes to the state or federal courts located in Virginia, and we each agree to that venue.
